El derecho humano al agua no se encuentra regulado en ningún instrumento vinculante de derecho internacional. Sin embargo, ello no ha impedido que, por interpretación, los sistemas de protección de derechos humanos hayan desarrollado en su jurisprudencia un conjunto de estándares relacionados a este derecho. En el sistema interamericano, estos estándares se construyeron, principalmente, sobre la interpretación de cuatro derechos civiles y políticos: propiedad, vida, integridad e igualdad y no discriminación. Los estándares desarrollados se adecúan al contexto interamericano y especialmente, a la protección de algunos grupos en situación de vulnerabilidad del continente, como los pueblos indígenas, las personas privadas de libertad o las personas en situación de pobreza o exclusión estructural ; The human right to water is not regulated in any binding international legal instrument. However, this has not precluded the formation of a set of standards that have developed out of the jurisprudence of human rights protection systems in addressing this right. Within the Inter-American system, these standards have focused on the interpretation of four civil and political rights: property, life, integrity, and equality and non-discrimination. Tras los ataques del 11 de setiembre de 2001 el gobierno estadounidense dio inicio a lo que sus propios agentes han calificado como la "guerra contra el terrorismo". En este contexto se enmarca la práctica conocida como entregas extraordinarias, dirigida al traslado ilícito de personas y su subsiguiente tortura o juzgamiento. Lejos de negar su realización, el ex presidente Bush consideró que este método era necesario para hacer frente al terrorismo. Marcando distancia respecto de su predecesor, a los pocos días de asumir la presidencia, Barack Obama, emitió dos órdenes ejecutivas que suponen un cambio importante en la política antiterrorista americana. No obstante, no ha abordado directamente el asunto de las abducciones ilegales. En tal sentido, el presente artículo analiza las respuestas que otorga el Derecho internacional frente a esta práctica y los retos que representa para la nueva administración. ; After 9/11 the American administration began the so-called "war against terrorism". In contrast, shortly after he assumed the presidency, Barack Obama signed two executive orders that constitute an important change in the antiterrorist policy. However, he still has not dealt directly with the issue of the illegal abductions. Salomón Lerner Febres was the President of the Truth and Reconciliation Commission of Peru from 2001 to 2003. After two decades of armed conflict, political violence and suffering due to an authoritarian regime, the Commission, created by the government of Peru, was established to face up to the factors which made violence possible, and to the consequences of destruction and of physical and moral suffering, especially in the most humble and impoverished sectors of Peruvian society. The Commission published its report on 28 April 2003. Salomón Lerner is now President of the Institute for Democracy and Human Rights at the Pontificia Universidad Católica del Perú, where he was Rector from 1994 to 2004. He was also President of the Union of Latin American Universities, where he had previously been Vice-President for universities in the Andean region. After studying law in Peru and obtaining a doctorate in philosophy from the Catholic University of Louvain (Belgium), Dr Lerner worked at a number of academic institutions and is currently a research associate at Tokyo University. In addition to several other awards, he was honoured as 'Great Official of the Order of Merit of Peru' by Peru's Ministry of Domestic Affairs in 2003.

AbstractThis article aims to determine what important new developments have emerged in reparation for victims of serious violations of international humanitarian law (IHL). Our hypothesis is that there have been significant new developments in this area of particular relevance to IHL and that reparation for victims of serious violations of IHL is increasingly being incorporated into this body of law as one of its key components. It is submitted that the following developments are evidence of this gradual transformation of IHL: (i) broad recognition of the right of victims of serious violations of IHL to reparation; (ii) extension of the scope of the obligation to provide reparation under IHL to include non-State armed groups and individuals as well as States; (iii) the existence of innovative domestic reparation mechanisms complemented or supervised by regional courts, as evidenced by experiences in Latin America; and (iv) the reparation system of the International Criminal Court as a global mechanism.
